JUSTICE RAJIV ROY ORAL ORDER 3 19-08-2026 Heard Mr. Kumar Mritunjay, learned counsel for the petitioner duly assisted by Ms. Pinki Kumari and Mr. Vyas Kumar Mishra for the opposite party. 2. The present petition has been preferred: “for transfer of Divorce petition vide Matrimonial Case No. 219/2024 under Section 13(J)(1) of Hindu Marriage Act filed by respondent/husband before Learned Principal Judge, Family Court at Gopalganj, titled Anish Kumar Ray Versus Riya Kumari to the Family Court, Patna or any other competent court in Patna.” 3. Learned counsel for the petitioner has taken this Patna High Court MJC No.2836 of 2025(3) dt.19-08-2026 2/3 Court to paragraph H and I which read as under: “(H) Because petitioner herein is unemployed and is currently living with her parents in Patna, wholly dependent on her parents and has no source of income for her livelihood and till now no maintenance/any expenses has been paid by respondent/husband for petitioner and her daughter.” (I)Because Gopalganj is approximately 150 Kms away from Patna which take 5 hrs by Road and theres is no frequently train from Patna to Gopalganj, petitioner is not able to pay private taxi rent from Patna to Gopalganj. 4. Learned counsel representing the opposite party also says that he has difficulty and there is apprehension in appearing before the transferred place but if he is allowed to appear through the video conferencing, has no objection. 5. The petitioner has no objection to the husband appearing through video conferencing. 6. In that background, with the consent of both the parties, Matrimonial Case No. 219/2024 is hereby transferred from the Court of the learned Principal Judge, Family Court, Patna High Court MJC No.2836 of 2025(3) dt.19-08-2026 3/3 Gopalganj to the Court of the learned Principal Judge, Family Court, Patna with liberty to both parties to appear either physically or virtually through video conferencing. 7. In the event that the learned Principal Judge, Family Court, Patna considers the physical presence of the parties necessary for the purpose of mediation, an appropriate order may be passed directing the parties to remain physically present on the particular date fixed for such mediation. 8.
