GP FOR REVENUE The Court made the following order: Aggrieved by the orders of the 4th respondent vide Roc.No.A/113/2021 dated 04.12.2021, the present writ petition is filed. 2. When the matter is taken for consideration, it was brought to the notice of this Court that, against the order impugned (issued by 4th respondent), an appeal has already been preferred before appropriate forum. 3. In Bombay Metropolitan Region Development Authority Bombay V. Gokak Patel Volkart Ltd1, it is held that writ court should not interfere in the matter where suit or any other proceeding is pending before the lower court or forum seeking same relief. It is also settled that, the litigants cannot be 1 (1995) 1 SCC 642 permitted to avail two parallel remedies simultaneously in respect of same matter at the same time. 4. In the light of above, this court is inclined to dispose of the writ petition giving liberty to the petitioner to pursue the appeal filed before appropriate forum. No costs.
