Learned advocate for the appellants / claimants submitted that the lands of the claimants were irrigated and had pipeline facilities. However, the learned Reference Court did not consider this aspect in its proper perspective and awarded a meager amount of compensation by holding that, in some matters, the lands of the claimants were irrigated and semi-irrigated. The amount of compensation was not properly determined considering the evidence adduced by the claimants, particularly the sale instances were not properly appreciated. He submitted that the reasons and findings recorded by the learned Reference Court are neither legal nor correct, either on facts or in law. He further pointed out the judgment of this Court delivered in First Appeal No.133 of 2007 and other connected matters dated 25.01.2021, wherein compensation of Rs.2,00,000/- 17 of 21 (( 18 )) 903(1) FA NO. 3205 OF 2008++ per hectare was awarded for irrigated land. He therefore submitted that the principle of parity be applied while awarding compensation to the claimants lands in the present appeals, as well as in the cross- objections filed by them in the other four appeals, which were withdrawn in view of the Circular of the State Government authorizing the learned AGP to withdraw appeals where the compensation awarded is not more than four times. Learned advocate for the claimants lastly prayed to allow the appeals as well as the Cross-Objections. 4. Learned AGP for the State and Learned advocate for respondent No.3 strongly opposed the appeals and cross-objections and submitted that there is no substance in the grounds of objections raised by the claimants. They submitted that the entire evidence was properly appreciated by the learned Reference Court and calculated the amount of compensation based on the evidence. They therefore submitted that no interference is warranted in the impugned judgments and awards and lastly prayed to dismiss the appeals and Cross-Objections. 5. Perused the impugned judgments and awards as well as the record and proceedings, along with the judgment relied upon by the 18 of 21 (( 19 )) 903(1) FA NO. 3205 OF 2008++ learned advocate for the appellants/claimants, delivered on 25.01.2021 in First Appeal No.133 of 2007. On perusal of the entire documentary evidence, particularly the 7/12 extracts and the oral and documentary evidence, it appears that except for the barren land shown in the table, the claimants’ lands are similarly situated. The lands in the vicinity are of the same quality and have the facility of a pipeline. This shows that the lands in question, which were acquired for one and the same project, are required to be compensated on the basis of the judgment delivered on 25.01.2021 in First Appeal No.133 of 2007 and other connected matters. 6. As regards to the First Appeal Nos.3540 of 2008, 4186 of 2008, 4187 of 2008, 4189 of 2008 and Cross-Objection No.35 of 2023 in FA/2917/2008, the learned Reference Court has already awarded compensation @ Rs.2,10,000/-, Rs.2,00,000/-, Rs.2,10,000/-, Rs.2,10,000/- and Rs.2,00,000/- per hectare respectively. Hence, the said appeals and Cross-Objection deserve to be dismissed. 7. Considering all these aspects and on the principle of parity, the cross-objections and the First Appeals excluding First Appeal Nos.3540 of 2008, 4186 of 2008, 4187 of 2008, 4189 of 2008 and 19 of 21 (( 20 )) 903(1) FA NO. 3205 OF 2008++ Cross-Objection No.35 of 2023 in FA/2917/2008, deserve to be partly allowed, and the impugned judgments and awards deserve to be partly set aside. Hence, the following order: :: ORDER :: a. The First Appeals except First Appeal Nos.3540 of 2008, 4186 of 2008, 4187 of 2008, 4189 of 2008 are partly allowed. The Cross-Objections except Cross-Objection No.35 of 2023 in FA/2917/2008, are partly allowed. b. The impugned judgments and awards are partly set aside and modified as under: c. The compensation awarded by the learned Reference Court is enhanced to Rs. 2,00,000/- per hectare for irrigated lands of the claimants in all the claim petitions along with statutory benefits. d. The claimants are entitled to compensation @ Rs. 50,000/- per hectare for their barren lands, along with statutory benefits including interest, etc., as per the provisions of the Land Acquisition Act. e. The First Appeal Nos.3540 of 2008, 4186 of 2008, 4187 of 2008, 4189 of 2008 and Cross-Objection No.35 of 2023 in FA/2917/2008 are dismissed. f. It is clarified that the claimants shall not be entitled to interest for the period of delay, if such delay is condoned by this Court. 20 of 21 (( 21 )) 903(1) FA NO. 3205 OF 2008++ g. The Acquiring Authority is directed to deposit the amount of enhanced compensation within 12 weeks, along with interest and other benefits accrued thereon. h.
