1. The Miscellaneous Petition seeks the relief of removal of Respondent as Executor and to appoint Mr. Rajan Suraj Manchanda as Administrator of the estate of the deceased.
2. This Court is informed that the Respondent has expired on 20th June, 2020. Hence, the relief no longer survives for consideration.
3. Perusal of the previous orders would indicate that this Court in these proceedings had appointed Commissioner for sale of property at Juhu, which was agreed upon by all the parties. Subsequent thereto, the reserve price was fixed and meetings were held for the purpose of sale of Juhu property. Though, the relief which is prayed for in the Petition, no longer survives for consideration, the orders passed by this Sairaj 1 of

19 MPT-48-2017.doc Court will continue to bind the parties. The parties are at liberty to proceed with the sale of property at Juhu in accordance with the orders passed in the Petition.
