In view of the fair submissions advanced by Mr. Shroff that the name of the Petitioner who is son and legal heir of deceased was not disclosed at the time of obtaining Grant and the fact that there is no dispute that Petitioner is son of the deceased, the Grant is required to be revoked. The Grant is therefore revoked and cancelled. Needless to state that all rights and contentions of both the parties are expressly kept open in appropriate proceedings that may be filed claiming 1 of 2 136. Original Grant shall be surrendered to the Department within a period of two weeks from today by the Respondent which shall be cancelled by the Testamentary Department. 4. Misc. Petition is disposed.
