The writ petition has been filed with the following prayers:- "(i) To issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 to pay revised pension on the basis of 66 months as per the 7th pay commission to the petitioner within stipulated period. (ii) To issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 to decide the representation dated 25.03.2025 pending before him." Learned counsel for the respondent-BSA submits that earlier the petitioner had filed Writ A no.20475 of 2023 with the same relief and the aforesaid writ petition was disposed of by the co-ordinate Bench of this Court vide order dated 29.01.2024, directing the respondent no.3, District Basic Education Officer, Pilibhit, to look into grievance of the petitioner and pay arrears in accordance with law. Pursuant to the aforesaid order, the petitioner was called by the concerned BSA with the relevant documents as is evident from Page-38 of the present writ petition, therefore, without waiting for the orders passed by the BSA, the present petition has been filed with the same prayer, which is premature and not maintainable. Accordingly, the writ petition is disposed of with a direction that, in case, final orders are passed by the concerned BSA pursuant to the earlier orders passed by this Court, the petitioner will be at liberty to challenge the same.
