1. In the instant contempt petition the petitioner herein has complained non- compliance of the order dated 11.10.2019 passed by this Court in terms whereof the writ petition of the petitioner came to be disposed of with a direction to the respondents to consider the case of the petitioner for promotion along with other eligible candidates as and when a process thereof is initiated for doing the needful and also consider the qualification of the petitioner as also the mandate of the Government Order No. 940- Edu of 2017 dated 17.11.2017.
2. The respondents/contemnors have filed a compliance report on 04.04.2025 accompanied with a consideration order bearing No. 266-JK (Edu) of 2025 dated 03.04.2025, wherein it has been, inter alia, stated that the case of the petitioner came to be examined and considered in the light of the directions passed by this Court as also in view of the communications of the Administrative Department dated 11.09.2023 along with recommendations contained in Government Order No. 940-Edu of 2017 as Arif Hameed I attest to the accuracy and authenticity of this document 16.04.2025
well as Government Order No. 252-HE of 2012, whereupon it got revealed that the petitioner is holding a Master’s degree in Environment Communication (MEC), instead of Environmental Science and, as such, a clarification has been sought from the Higher Education Department as well as the Registrar of Academics at the University of Kashmir which is still awaited and that the department is in the process of verifying the same and that the case of the petitioner for his promotion would be considered thereafter in as much consequent to the inclusion of this name in the final seniority list along with other eligible candidates.
3. Having regard to the aforesaid position obtaining in the matter, the respondents/contemnors at this stage cannot be said to have failed to comply with the order where under the instant contempt petition has arisen.
4. Accordingly, for the aforesaid reason contempt notice is recalled and the contempt proceedings are closed, however with a liberty to the petitioner to re-agitate the matter in the event cause survives.
