NARASINGH Order No. ORDER 17.11.2025 01. 1. Heard learned counsel for the Petitioner and learned counsels for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1576 of 2025 pending on the file of learned J.M.F.C.-II (Cog. Taking), Cuttack, arising out of Dargha Bazar P.S. Case No.260 of 2025 for commission of offences punishable under Sections 191(2)/ 296/ 121(1)/ 121(2)/ 132/ 351(3)/ 109(1)/ 326(g)/ 190/ 191(3)/ 195(1)/ 192/ 196/ 221/ 299/ 302 of B.N.S., 2023, R/w. Sec. 4 of Prevention of Damage to Public Property Act and Sec. 7 of Criminal Law (2nd Amendment) Act. 3. It is submitted by the learned counsel that omnibus allegations have been made in the light of the commotion which was created during the immersion process. Hence, the Petitioner may be protected by pre-arrest bail. 4. Learned counsel for the Petitioner, on instruction, submits that for the selfsame occurrence, the Petitioner is cited as an accused in three other cases. Save and except the same, the Petitioner does not have any criminal proclivity. Hence, he seeks release on pre-arrest bail. 5. Learned counsel for the State opposes such prayer. 6. Considering the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification criminal antecedent other than connected with the incident in question. 7. If it comes to fore that the Petitioner has any criminal antecedent other than connected with the incident in question, this order shall not be given effect to. 8. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 9. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules. (V. NARASINGH) Judge Soumya
