JUSTICE S. B. PD. SINGH ORAL ORDER 2 17-09-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners have preferred this application for grant of regular bail in connection with Bhalpatti P.S. Case No. 128 of 2024 registered for the offences punishable under Sections 331(4), and 305 of the BNS. 3. As per the prosecution story, the informant has

No.66582 of 2025(2) dt.17-09-2025 2/3 alleged that 28.11.2024, unknown individuals unlawfully entered his house and stolen several valuable items, including clothing worth approximately Rs. 2,50,000/- and jewelry valued at around Rs. 80,000/-. 4. Learned counsel for the petitioners submits that the petitioners are innocent and they have committed no offence at all rather they have been falsely implicated in this case as well as in so many other cases only on suspicion. No incriminating article has been recovered from their possession and there is no eye witness of this alleged occurrence. Except suspicion, nothing has come against these petitioners, there is no evidence on record to show the involvement of the petitioners in this case. they have never been put on Test Identification Parade. They are languishing in jail since 10.01.2025. 5.
Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners. 6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioners, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Darbhanga in connection with Bhalpatti

Petitioners will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
