JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 17-09-2025 Heard learned counsel for the petitioner and the State . 2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 406, 467, 468 , 120 B of the Indian Penal Code . 3 . As per the prosecution case , informant namely , Mosim Raja alleged that co-accused Arvind Kumar who joined Naugachhia Branch on 01.11.2021 as Sargam Manager Training and worked for one year and eight months and thereafter, he got transferred and finally left job after 9 months. During the aforesaid tenure , co-accused Arvind Kumar embezzled Rs. 9,73,637/- of 88 members. During course of investigation , it came into light that total Rs. 20,99,874/- was embezzled of 32 centres were embezzled. It is further alleged that another three

No.65112 of 2025(2) dt.17-09-2025 2/3 Sargam members including this petitioner had also embezzled the money in which this petitioner Amarjeet Kumar emebezzled Rs.26,777/- , co-accused Manish Kumar embezzled Rs. 49,908/- , and co-accused Abhishek Kumar embezzled Rs. 38,782/-. 4. Learned counsel for the petitioner submitted that petitioner has not defalcated any amount. As a matter of fact, petitioner had already left the Company due to revengeful attitude of Branch Manager, as he implicated the name of this petitioner, in this present false and concocted case . It is further submitted that petitioner without admitting his guilt and without prejudice to his right and contention , he is ready to deposit the alleged amount of Rs. 26,777/- in the Nazarat of the concerned Civil Court. 5 . Learned counsel for the State does not dispute the contention made on behalf of this petitioner. 6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed.
In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial

No.65112 of 2025(2) dt.17-09-2025 3/3 Magistrate Katihar in connection with Kursela P S Case No. 10 of 2025 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure as well as on following conditions:- (i) At the time of furnishing bail bond, Rs. 26,777/- shall be deposited by the petitioner in the Nazarat of the Court below through Demand Draft of S.B.I. (ii) If the petitioner fails to comply with the aforesaid direction of this court, the court below shall be at liberty to cancel the bail bonds of the petitioner. 7 . It is made clear that without going into the merit of the case, aforesaid order has been passed only for the purpose of grant of bail and this deposit would be subject to the final result of the criminal case .
