The present application has been filed by applicant for quashing the impugned summoning order dated 9.4.2025 as well as impugned charge-sheet dated 18.3.2025 passed in Case No.4016 of 2025 (State Vs Suraj and others) arising out of Case Crime No.17 of 2025, under Section 85, 80(2) B.N.S. & Section 3/4 D.P. Act, P.S. Obra, District Sonbhadra pending in the Court of Chief Judicial Magistrate, Sonbhadra. 3. After some argument, learned counsel for the applicant prays that applicant may be permitted to move appropriate application before the Court concerned as provided under Section 250(2) of the BNSS. 4. This prayer has not been opposed by the learned AGA. 5. Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application under Section 250(2) of the BNSS claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously. 6.
