2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126 (2), 115 (2), 76, 352, 351 ( 2 ) and 3 (5) of BNS. 3 . As per the prosecution case, informant namely, Rubi Devi alleged that on 13.04.2025, at about 5 PM, her minor daughter was playing with ball which got bounced away in the house of her neighbour and when daughter of informant went to take her ball, this petitioner came from behind and forcibly opened her pants and also molested her. It is further alleged that

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged. Both the parties are next door neighbours. The entire prosecution story is an after thought. As a matter of fact, there is land dispute between both the parties and taking advantage of the situation, this false and concocted case has been lodged against him. Petitioner claims clean antecedent.
5. Learned counsel for the State opposed the prayer for bail and submitted that the victim in her statement recorded under Sections 180 as well as 183 B.N.S.S. has supported the prosecution case and Court below assessed the age of victim as 10 years.
6. Considering the nature and seriousness of accusation , statement of the victim recorded under Section 183 B.N.S.S., the prayer for pre-arrest bail of the petitioner is hereby rejected.
