The Court made the following Order:
The learned counsel for the petitioner submits that the petitioner is aggrieved by the inaction on the part of the 4th respondent in not registering the complaint dated 01.02.2025 and the said complaint addressed to the 2nd respondent alleging the involvement of the 4th and 5th respondents in a case. As the complaint is filed against the Police Officer, no action has been taken by the 3rd respondent.
2. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader submits that no such representation was received by the 3rd respondent.
3. It is also submitted by the learned Assistant Government Pleader for Home that there are no records when the petitioner was called to the Police Station. It is submitted on instructions that, the petitioner was not informed the same to the Police Station at any point of time.
4. Be that as it may, this Court deems it appropriate to dispose of the writ petition at the stage of admission, permitting the petitioner to file a detailed representation to the 4th respondent and on such representation, the 4th respondent shall be considered in accordance with law as contemplated under Section 173 (3) of BNSS.
5. Accordingly, this Writ Petition is disposed off. There shall be no order as to costs.
