JUSTICE RAJIV ROY ORAL ORDER 2 18-09-2025 Heard Mr. Sheo Nandan Prasad, learned counsel for the petitioner and Mr. Ram Sumiran Rai, learned counsel representing the informant as also Mr. Mohammad Sufyan, learned APP representing the State. 2. The petitioner is apprehending his arrest in connection with Baughat P.S. Case No. 33 of 2025 registered for the offence punishable under Sections 115(2), 126(2), 303(2), 352, 109, 118(1), 75, 351(2)(3) and 3(5) of the B.N.S., lodged on 12.06.2025 by the informant Sonelal Kumar. 3. As per the prosecution story, the informant alleged that while he was sitting with his mother in his house, suddenly the petitioner came armed variously and thereafter attacked the mother causing injury on the lips and cheeks, it led to treatment and she got seven stitches beside swelling on the head. When he Patna High Court CR. MISC. No.66453 of 2025(2) dt.18-09-2025 2/2 tried to save her, Manti Devi and Ramsharan Mahto also assaulted him with iron causing injury to him. As the locals came, they retreated. The injured were shifted to Sadar Hospital Sheikhpura whereafter the case. 4. Learned counsel for the petitioner submits that though the injury has been found to be grievous, so far as the mother of the informant is concerned, the report shows that hard blunt substance thus negating the arms that was used by the petitioner. 5. Learned counsel for the informant on the other hand submits that a perusal of the F.I.R. would show that how brutally the mother was assaulted by this petitioner himself. 6. Considering the submissions of the parties as also the direct allegation that has come against this petitioner, as per the learned Sessions Judge observation, the injury has been found to be grievous in nature, in that background, no relief can be extend to him. 7.
