IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 118 CWP-18650-2025 (O&M) Date of decision : 09.07.2025 JAGAN NATH
...... Petitioner VERSUS THE PUNJAB STATE COOPERATIVE SUPPLY AND MARKETING FEDERATION LIMITED AND OTHERS ...... Respondents
CORAM : HON'BLE MR. JUSTICE DEEPINDER SINGH NALWA Present :- Mr. Shiv Kumar, Advocate and Mr. Lovedev Singh, Advocate for the petitioner. *** Deepinder Singh Nalwa, J. (Oral)
1. In the present writ petition, the petitioner has challenged the charge sheets dated 23.08.2018 (Annexure P-3) and 27.06.2023 (Annexure P- 6), issued to the petitioner.
2.
Learned counsel appearing on behalf of petitioner submits that the said charge sheets were issued to the petitioner while he was in service. The petitioner retired on 30.06.2023 on attaining the age of superannuation. He contends that the departmental proceedings are being continued even after the retirement of the petitioner under 2.2 (b) of the Punjab Civil Services Rules, Volume II (for short the 'Rules'). He submits that the post on which, the petitioner was working was not a pensionable post. Therefore, there is no question of withholding or withdrawing of the pension in the case of petitioner as such and there is no purpose of continuing with the charge sheets issued to the petititioner. It is also the case of the petitioner that no punishment can be imposed upon the petitioner after retirement.
