OMP(M) No.61 of 2023 There is no appearance for the respondent, who otherwise has already been proceeded against ex-parte. No application for setting aside the ex-parte order dated 02.11.2023 has been moved till date by the respondent. 2. There is no opposition to the application seeking condonation of delay. 3. Learned counsel for the applicant/appellant has placed on record copies of orders passed in different OMP(M)s in different cases instituted by the applicant/ appellant involving the same judgment, wherein the delay in filing the appeal has been condoned. 4. In view of the orders already passed in the similar matters and also taking into consideration the averments made in the application, it would be in the interest of justice, in case the delay in filing the appeal is condoned and the appeal is decided on merits. Accordingly, the application is allowed. Delay in filing the appeal is condoned. The application to stand disposed of. Arb. Appeal No.81 of 2025 5. Be registered. List for consideration on 28.04.2025. OMP No.306 of 2025 6. Subject to deposit of entire awarded amount alongwith up to date interest in the Registry of this Court within a period of two weeks, operation and execution of impugned judgment dated 18.11.2021, passed by the learned District Judge Mandi, H.P. in Arbitration Case No.108 of 2018 (National Highways Authority of India Versus Hem Raj), shall remain stayed.
