JUSTICE KAUSHIK GOSWAMI ORDER 07.04.2025 Heard Mr. A Hawari, learned counsel for the petitioner and Mr. S C Keyal, learned Standing Counsel, NCB for the respondent. 2. This is an application under Section 482 of BNSS, 2023 seeking grant of pre-arrest bail to the accused petitioner, i.e., Saha Alam Thandar, who is apprehending arrest in connection Page No.# 2/2 with NCB Crime No. 09/2024 under Section 8 (c) read with Sections 22(c) and 29 of the NDPS Act, 1985. 3. This Court on 14.02.2025 after hearing the matter was pleased to grant interim pre- arrest bail to the petitioner subject to conditions. 4. Mr. S C Keyal, learned Standing Counsel, NCB submits that pursuant to the aforesaid interim pre-arrest bail, the petitioner appeared before the Investigating Officer of the case and his statement was accordingly recorded. He further submits that during investigation no adverse material has been collected against the accused petitioner. He further places the said report. 5. Perusal of the aforesaid report it is apparent that there is no adverse material available against the accused petitioner. Thus it appears that the petitioner is not guilty of the alleged offence. 6. That being so, the interim pre-arrest bail granted to the petitioner earlier on 14.02.2025 is hereby made absolute. 7. It is needless to clarify that the petitioner shall co-operate in the investigation of the case and shall appear before the Investigating Officer as and when called. 8. This pre-arrest bail application accordingly stands disposed of. 9. Copy of the report dated 24.02.2025 furnished today by Mr. S C Keyal, learned Standing Counsel, NCB is kept on record and marked as ‘X’. JUDGE Comparing Assistant
