No. 7902 of 2025 Heard the parties. This interlocutory application has been filed with a prayer for early hearing of this bail application. Since, hearing of this bail application is taken up today, this interlocutory application is disposed of being infructuous. (Anil Kumar Choudhary, J.) B.A. No. 1936 of 2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Deoghar Cyber Crime P.S. Case No.141 of 2024 registered for the offences punishable under sections 319(2)/ 318(4)/ 338/ 336(3)/ 340(2)/ 61 of the B.N.S., 2023 and Section 66B/66C/66D & 84 C of I.T. Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and he has defrauded the victim Sameer Kumar Karan to the tune of Rs.1,99,999/-. It is next submitted that the allegation against the petitioner is false. It is also submitted that two mobile phones with sim card was recovered from the possession of the petitioner. It is then submitted that the petitioner has been in custody since 30.12.2024 as is evident from para-17 of the instant bail application. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.15 of the bail application. It is further submitted that the petitioner undertakes to transfer Rs.1,99,999/- to the Bank Account of Sameer Kumar Karan without prejudice to his defence in this case. It is lastly submitted that the petitioner also undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned Spl. P.P. appearing for the State opposes the prayer for bail of the petitioner. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transfer of Rs.1,99,999/- to the Bank Account of Sameer Kumar Karan without prejudice to his defence in this case and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Spl. Judge Cyber Crime Case, Deoghar in connection with Deoghar Cyber Crime P.S. Case No.141 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
