3. The present application under Section 483 of the BNSS seeks interim bail in case FIR No. 308/2024, under Sections 452/307 of the IPC, registered at P.S. Sarai Rohilla for a period of 4 weeks on the ground that the applicant’s wife has given birth to his child recently and he has to look after them.

Learned counsel appearing on behalf of the applicant submits that the author of the FIR has been examined before the learned Trial Court and he has not supported the prosecution case. It is also pointed out that the interim bail application being CRL.M(BAIL) 2064/2024 in BAIL APPLN. This is a digitally signed order. 4002/2024 seeking interim bail during the pendency of the said bail application in the same case FIR has been withdrawn vide a separate order of the even date. 5. Issue notice. 6. Learned APP for the State accepts notice and, on instructions of the Investigating Officer, submits that the factum of the child’s birth has already been verified. He has also confirmed the fact that the author of the FIR has been examined and that he has not supported the same of the prosecution. 7. In view of the aforesaid facts and circumstances, the present application is allowed. The applicant is directed to be released on interim bail for a period of one week from the date of his release, on his furnishing a personal bond of Rs. 50,000/- with one surety of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions: - i. The applicant shall not leave India without prior permission of the learned Trial Court. ii. The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address. iii. The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. iv. The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v. The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner. 8. The application is partly allowed and disposed of accordingly. 9. Copy of the order be sent to the concerned Jail Superintendent for This is a digitally signed order.
