A preliminary objection has been raised by learned counsel for the Gaon Sabha as to the maintainability of the writ petition on the ground that the notice was issued in Form RC 20 in the name of Ram Kripal and the petition has been filed in the name of the institution. According to the learned counsel for the Gaon Sabha, the entire proceeding was initiated in the name of Ram Kripal and the present writ petition cannot be maintained at the behest of the institution. 2. Learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to file afresh in the name of Ram Kripal. 3. In view of the said fact, the writ petition stands dismissed with the liberty as prayed for. 4. Office to return back the certified copy to the petitioner's counsel within 48 hours.
