ORAL ORDER
Petitioner, with a prayer for anticipatory bail has preferred this petition under Section 482 of the BNSS.
2. Heard both sides and perused the material on record.
3. Crime No.25/2024 of Cyber Crime Police Station, Bengaluru City is registered against two named accused for the offence Punishable under Section 66(C), 66(D) of the Information Technology Act, 2000 and Section 419, 420 of IPC.
4. The sum and substance of the complaint averments are that, accused Nos.1 and 2 named in the FIR have provided free classes on Trading and Company
Analysis and added the complainant to a WhatsApp group of more than 110 members. Accused recommended the

members to buy stocks from his VIP trading account and asked them to shift regular trading accounts to a high net-worth VIP account. It is alleged that complainant was forced to invest money which was borrowed from several others and he transferred a total sum of Rs.1.53 Crores to various bank accounts provided by them.
5. The petitioner is said to be one of the Directors of the company called 'Poltergeist Pay Technologies', a technology service provider. His name is not in the FIR. In the remand application, he is shown as accused No.13. The allegations are that even the Directors of the said company are involved in the alleged fraudulent activities. However, in the FIR, the allegations are against accused Nos.1 and 2.
6. The prayer of the petitioner for anticipatory bail has been rejected by the learned Sessions Judge in Crl.Misc.No.1643/2025 vide order dated 25.03.2025. Hence, the petitioner is before this Court.

7. According to the complainant, he was induced by the accused persons to invest huge money in online trading with a promise of huge profit, but he was cheated.
8. The allegations against the petitioner have to be proved in due course. Similarly placed accused, namely Directors of 'Poltergeist Pay Technologies' have been enlarged on bail by the Trial Court as well as this Court. The offences alleged are not punishable with death or imprisonment for life. The petitioner has undertaken to cooperate with investigation of the case. The apprehension of the prosecution that the petitioner may not cooperate with the investigation and he may flee from justice etc., can be met with by imposing suitable conditions. Hence, the following:
ORDER i) Petition is allowed. ii) Petitioner/accused No.13 in Crime No.25/2024 of Cyber Crime Police Station, Bengaluru City, shall be

released in the event of his arrest, subject to following conditions:
a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum. b) He shall cooperate with the investigation of the case. c) He shall furnish proof of his residential address/contact number and shall inform the I.O. in case of change in the address/contact number. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
