This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No. 3037 of 2021 in case crime no. 528 of 2017 under Sections 147, 323, 504, 506, 120B I.P.C., Police Station- Nandganj, District- Ghazipur pending in the Court of learned A.C.J (S.D.) Ghazipur expeditiously within stipulated period. 2. Heard learned counsel for the applicants as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicants that the the applicants before this Court are the accused persons. It is further submitted that prosecution evidence in this matter has been completed but however, he is unable to apprise this Court as to which stage the said case is pending. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. It appears from perusal of the copy of the order sheets appended with the affidavit that the prosecution evidence has not started so far, hence the submission of the learned counsel for the applicants made before this Court is totally wrong. It further reveals from the order sheets that even the charges have not been framed in this matter. 7. In view of the above and also keeping in view the wrong submissions of the learned counsel for the applicants, I do not find any good ground to provide any relief to the applicants/ accused present in this case. 8. The application is rejected.
