learned counsel for the petitioner and learned Assistant Government Pleader for Services-I for respondents 1 to 3. A charge memo vide Rc.No.350/A2/2022-23 dated 06.03.2023 (Ex.P.1) was issued to the petitioner. The petitioner submitted a written explanation by way of a written defence dated 27.03.2023 (Ex.P.2).

Learned counsel for the petitioner would submit that though the petitioner is eligible for promotion, the petitioner’s case is not considered for promotion due to the pendency of the aforementioned charge memo.
2 Learned Assistant Government Pleader for Services, on the other hand, would submit that the inquiry will be concluded in terms of G.O.Ms.No.91 General Administration (Ser.C) Department, dated 12.09.2022. Learned AGP would also submit that the case of the petitioner will be considered for promotion in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999.
4. As seen from the charge memo (Ex.P.1), it was issued on 06.03.2023 and the petitioner submitted an explanation on 27.03.2023.

The Government issued G.O.Ms.No.679 dated 01.11.2008 and G.O.Ms.No.91 dated 12.09.2022 fixing the timelines to complete the cases in three months and six months in case of simple and complicated cases respectively. However, in the case at hand, the inquiry has not been completed so far despite the petitioner’s written explanation. For the fault of respondent authorities in concluding the inquiry, the petitioner shall not be penalized regarding promotion.

Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of, at the admission stage, with the consent of learned counsel on either side directing respondents 1 and 2 to conclude the inquiry, in pursuance of Ex.P.1 charge memo, within three months from the date of receipt of copy of this order. The respondents shall also consider the petitioner’s case for promotion to the post of Deputy Extension Mass Media Officer, if her case is in the zone of consideration, strictly in terms of G.O.Ms.No.257, dated 10.06.1999 as and when DPC is constituted. No order as to costs.
7. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
