order dated 21.10.2024 (Annexure P-17) and impugned order dated 22.05.2025 (Annexure P-19) passed by respondent No. 3 whereby the promotion of the petitioner on the post of DIG/IG w.e.f. 30.11.2006 has been declined without considering the material facts and against the settled preposition of law and further direction to the respondents to restore the seniority of the petitioner as Commandant and to regularize his promotion and further to grant him notional promotion as ADIGP/DIGP w.e.f. 30.11.2006 and promote him as IGP w.e.f. 28.09.2012 along with all consequential benefits arising therefrom in the interest of justice. CWP No. 25008 of 2025 2 Counsel for the petitioner would submit that order dated 22.05.2025 (Annexure P-19) is cryptic and non-speaking order whereby the claim of the petitioner for retrospective promotion as DIG and IG w.e.f. 30.11.2006 and 28.09.2012 respectively has been declined. Counsel for the petitioner argues that declining the relief to the petitioner is arbitrary and illegal and against the settled principle of law. Counsel for the petitioner confines his prayer at this stage that the instant petition has been filed for seeking adjudication of the representation dated 05.05.2025 (Annexure P-18) for passing a detailed speaking order of providing the petitioner an opportunity of hearing. Mr. Indresh Goel, Senior Panel Counsel appearing on behalf of the respondents accepts notice, who is not in a position to decline to the above said proposal of the petitioner and indeed undertakes that petitioner will be provided an opportunity of hearing and necessary speaking order will be passed in accordance with law by recording reasons therein either for acceptance or rejection as per the service rules governing the conditions of petitioner’s service within a period of six weeks from the date of receipt of certified copy of this order. Petition is disposed of in the aforesaid terms.
