Khan, learned counsel for the petitioner having realized that the writ petition would not be maintainable in view of the fact that the petitioner has failed to challenge the order passed by the Commissioner Appeals dated 21.01.2021, prays that he may be allowed to withdraw this petition with liberty to file afresh. Mr. S.C. Keyal, learned standing counsel, DRI is present. Prayer of the petitioner is accepted. Accordingly, the writ petition stands dismissed on withdrawal with liberty to file afresh as may be permissible under the law.
