Neutral Citation No. - 2025:AHC:1025 Court No. - 79 Case :- MATTERS UNDER ARTICLE 227 No. - 8309 of 2024 Petitioner :- Arun Kumar Verma Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Yakub Ali Counsel for Respondent :- G.A. Hon'ble Saurabh Srivastava,J. 1. Heard learned counsel for the petitioner and learned A.G.A. for the State. 2. The instant petition has been preferred for challenging the order dated 26.07.2023 passed by learned Chief Judicial Magistrate, Ballia in Criminal Case No.3369 of 2021 (Arun Kumar Verma vs. Rakesh Kumar Singh and Others), through which application under section 156(3) Cr.P.C. preferred on behalf of the petitioner has been rejected as well as order dated 03.05.2024 passed by learned Session Judge, Ballia in Criminal Revision No.8140 of 2023 (Arun Kumar Verma Vs. State of U.P.), through which order dated 26.07.2023 has been affirmed. 3. Learned counsel for the petitioner submitted that the impugned orders passed by learned trial court as well as learned revisional court are passed without applying its judicial mind and in a casual manner, and as such the same are liable to be set-aside. 4. Per contra, learned A.G.A. vehemently opposed the prayer as made in the petition and rebutted the stand taken up by learned counsel for the petitioner by way of submitting that after considering the material available on record, learned concerned courts rightly passed the orders, which impugned the present petition. 5. After hearing the rival submissions extended by learned counsel for the parties and by bare perusal of record, I find no infirmity and perversity in the impugned orders passed by learned concerned courts and as such, this petition stands dismissed.
