1. Ms. Joshi, the learned Counsel for the Petitioner states that in view of the decision of the Supreme Court in the case of R.S. Madireddy and Anr. ETC Vs. Union of India & Ors. ETC., the present Petition is not maintainable. She therefore submits that liberty be granted to the Petitioner to withdraw this petition and pursue an appropriate remedy as may be available to the Petitioner.
2. The learned Counsel for Respondent Nos. 1 to 3 has no objection to the submission made by Ms. Joshi.
3. In this view of the matter, we permit the Petitioner to withdraw the Petition to pursue appropriate remedy. The Petitioner is permitted to pursue the appropriate remedy within a period of six weeks from today. If such a proceeding is filed within the stipulated time, it shall be considered without any objection regarding limitation, since the petitioner had been pursuing the present petition bona fide.
4. Petition is disposed of in the aforesaid terms. All contentions of the parties are expressly kept open.
