Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record. 2. This writ petition has been filed for following relief: "To call for records and to issue appropriate order or direction directing the learned Civil Judge, Junior Division, Fast Track Court No. 1, Varanasi to decide the temporary injunction application filed 'under Order 39 Rule 1 and 2 of Code of Civil Procedure Paper No. 6-C in Original Suit No. 4389 of 2022 Nageena Singh Vs Rakesh Singh and Others within a specified time schedule preferably on the next date fixed into the matter." 3. Learned Standing Counsel drawn the attention of the Court page no. 87 of the writ petition and submitted that earlier also a petition bearing Matters under Article 227 No. 1297 of 2023 (Smt. Madhuri Singh v. Nageena Singh and 3 others) was filed by the petitioner for the same relief which was disposed of by order dated 16.02.2023. 4. In view of the Rule 7 of Chapter XXII of the Rules of the High Court Rules, 1952, second writ petition for the same relief, is not maintainable. 5. Accordingly, the writ petition is dismissed.
