Neutral Citation No. - 2025:AHC:117822 Court No. - 5 Case :- WRIT - A No. - 9928 of 2025 Petitioner :- Vedpal And 75 Others Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Anil Kumar Srivastava,Poonam Srivastava Counsel for Respondent :- A.S.G.I.,Santosh Kumar Mishra Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Anil Kumar Srivastava, learned counsel for petitioners and Sri Santosh Kumar Mishra as well as Sri Pranjal Mehrotra, Advocates for respondents.
2. Petitioners (76 in numbers) are claiming that they have worked between 2005 to 2013 for more than 240 days in a year, however, from 2013 they were not allowed to work, however, it remains a vague averment since no document in support of submission is placed on record.
3. Learned counsel for petitioners submits that in similar circumstances this Court has directed that representation of similarly situated workmen be decided by concerned respondent and he placed reliance on this Court’s order passed in the case of Ashok Kumar and others vs. Union of India and others, 2025:AHC:113223.
4. Learned counsel for respondents submits that petitioners are claiming to be workmen, therefore, they have an alternative remedy to raise industrial dispute and for that he placed reliance on a judgment passed by Supreme Court in Steel Authority of India Ltd. and others vs. National Union Water Front Workers and others, AIR 2001 SC 3527.
5. I have considered the above submissions. The submission of
learned counsel for respondents has substance that petitioners have an alternative remedy to raise industrial dispute, however, the Court also takes note that in similar circumstances this Court has passed direction to respondents to communicate the legal impediment, if any. Therefore, at this stage, Court is not taking any contrary view and this writ petition is disposed of with observation that respondents have liberty to communicate the legal impediment, if any, by referring aforesaid judgment in Steel Authority of India (supra).
