CORAM:
JUSTICE B. P. ROUTRAY
ORDER 30.10.2025
Order No.
01.
1. Heard Mr. P.K. Satapathy along with Mr. T. Sahu, learned counsels for the Petitioners.
2. Present C.M.P. is directed against order dated 06.09.2025 passed by the learned Senior Civil Judge, Sambalpur in C.S. No.119 of 2024, wherein the learned trial court considering the objection raised by the Defendants has directed the Plaintiffs to value the suit correctly.
3. It is submitted on behalf of the Petitioners, who are the Plaintiffs in the suit, that, the order of the learned trial court with regard to valuation of the suit property is not specific and secondly, the valuation furnished by the Defendants is not supported by any material evidence.
4. Perusal of the petition filed by the Defendants (Annexure-4) and the objection thereof filed by the Plaintiffs (Annexure-5) reveals that the Defendants have objected to enhance the valuation of suit land at Rs.65,16,522/- as per the bench mark Digitally Signed Signed by: BASANTA KUMAR BARIK Reason: Authentication Location: High Court of Orissa, Cuttack Date: 30-Oct-2025 15:40:17 Signature Not Verified p. 2 valuation according to the report issued by the Sub-Registrar, Sambalpur and such contention of the Defendants is not specifically denied in the objection of the Plaintiffs. It is further seen from the impugned order, read as whole, that the same depicts the valuation of the suit accordingly to the report of the Sub-Registrar at Rs.65,16,522/- and there is no ambiguity in the impugned order in that respect. Thus, the contentions raised by the Petitioners (Plaintiffs) in both the aspects found unsustainable.
5. Accordingly, the C.M.P. is dismissed.
6. However, as prayed by the Petitioners, they are permitted to value the suit correctly in terms of the impugned order and to pay the court fees accordingly within a period of thirty days from today.
