2 connection with Crime No. 852/2024, registered at Police Station – Supela District – Durg (C.G.) for the alleged commission of offence punishable under Sections 109 & 112 of the Bhartiya Nyaya Sanhita, 2023.

As per the case of the prosecution at the night of 05.08.24, Umesh Kumar Verma, son of Naresh Verma, who works as a manager at the premium liquor store Akashganga Supela, after closing the shop and doing the accounts, was going to his home Krishna Nagar on his motorcycle at around 01:00 in the night, when 03 unknown boys blocked his way and attacked him with a sharp knife with the intention of killing him, due to which he got injured. the applicant was arrested on 01.09.2024 by the police of Police Station- Supela District Durg (C.G.) for the alleged offence punishable under Sections 109 & 112 of B.N.S.S. 2023.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that there is no substantive evidence that the applicant participated in the alleged acts of violence. The prosecution has failed to provide credible proof of the applicant’s involvement, and the charges appear to be based solely on personal enmity. He further submits that there is no direct or corroborative evidence linking the applicant to the alleged offence, he has been falsely implicated in the present case, Therefore, he prays for releasing the applicant on regular bail.

On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant and submits that the present applicant along with other co-accused person assaulted the injured by knife due to which the injured received grievous injuries, therefore, the applicant is not entitled for grant of bail.
6. I have heard learned counsel for the parties and perused the case diary.

Considering the nature and gravity of the offence and material on record in the case diary, it appears that the present applicant along with other co-accused person assaulted the injured by knife due to which the injured received grievous injuries, therefore, I am not inclined to grant regular bail to the applicant.

Accordingly, the anticipatory bail application of the applicant – Shailesh Sinha, involved in Crime No. 852/2024, registered at Police Station – Supela District – Durg (C.G.) for the alleged commission of offence punishable under Sections 109 & 112 of the Bhartiya Nyaya Sanhita, 2023, is rejected.
