Vashistha, A.P.P. --- 03 / 19.03.2025 Heard the parties. 2. Petitioner has been made accused in connection with Jasidih P.S. Case No. 245 of 2024 for the offences registered under sections 70(1) / 64(2) (m) / 89 of the Bharatiya Nyaya Sanhita, 2023 and section 6 of POCSO Act, pending in the court of learned Additional Sessions Judge- III-cum-Special Judge, POCSO, Deoghar. 3. On 06.12.2023, named accused persons Karan Kumar, Luv Raut, this petitioner and Pramod Kumar Mandal are alleged to have raped the prosecutrix. Subsequently, accused Karan Kumar on the pretext of marriage, continued to sexually exploit her. Thereafter, the prosecutrix became pregnant and ultimately, co-accused Karan Kumar refused to marry her. 4. Learned counsel appearing on behalf of the petitioner submitted that co-accused Kumud Mandal has been granted bail by this court and the case of the petitioner stands on similar footing. 5. However, Mr. Vineet Kumar Vashistha, learned Special P.P has opposed the prayer for bail and submitted that the case of the petitioner stands on different footing to that co-accused Kumud Mandal who was granted bail as in the First Information Report, initially, the prosecutrix had named Karan Kumar, Luv Raut, this petitioner and Pramod Kumar Mandal as the persons who had sexually assaulted her. There is specific allegation against the petitioner that he had sexually assaulted the prosecutrix. 2. 6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J) Ranjeet/ Uploaded
