Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The petitioner, Shri Shiv Pujan Baba (Guleri Baba), has filed the present writ petition seeking a writ in the nature of mandamus directing the respondents to release the remaining amount of Rs. 79.81 lakhs against the sanctioned amount of Rs. 120.56 lakhs under the Chief Minister Tourism Development Participation Scheme. 3. Upon perusal of the record, it is evident that the grant of financial assistance under the said Scheme is subject to conditions, including implementation by the designated agency and co-contribution by Shri Jai Kishan Sahu, Hon’ble MLA, Sadar, Ghazipur, as stipulated in the Government Order dated 18.07.2024. The petitioner has already moved representations to the Chief Minister and the Principal Secretary, Government of Uttar Pradesh, regarding the release of funds. 4. The petitioner has no vested legal right to claim Versus Counsel for Petitioner(s) : Deepak Kumar Pandey, Udai Shankar Chauhan Counsel for Respondent(s) : C.S.C. Shri Shiv Pujan Baba (Guleri Baba) Divyalok Ashram Trust .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) immediate release of the sanctioned amount, and the respondents are required to act in accordance with the provisions and conditions of the Scheme. Mere delay or non-communication by the authorities does not entitle the petitioner to invoke the extraordinary jurisdiction of this Court. 5. Accordingly, the writ petition is dismissed.
