THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs; a. "Issue a Writ of Mandamus or such other appropriate Writs directing the Respondents to settle the unpaid bills for the purpose of COVID RT PCR during the period 2020-2022 which was conducted on the instructions of the Respondents and ICMR within a span of 3 months or within such time as may be deemed fit and reasonable by this Hon'ble Court; and b. Consequently, direct the Respondents to pay the balance invoice amount of Rs. 6,03,56,815/- (Rupees Six Crores Three Lakhs Fifty Six Thousand Eight Hundred and Fifteen only) to the Petitioner as represented by the Petitioner at Annexure-A dated 18.12.2023 , Annexure-B dated 14.07.2025 and Annexure-C dated 14.07.2025; c. Grant such other reliefs as this Hon'ble Court deems fit in the facts and circumstances of this case." - 3 - HC-KAR NC: 2025:KHC:43848 WP No. 24219 of 2025 2. The grievance of the petitioner is that the bills which had been submitted by the petitioner in pursuance of the work order issued have not been considered and necessary payment made. 3. Whenever any bills are submitted it is but required for tendering authority to consider the same and make payment of the due amounts or reject the bills within a reasonable period of time. Needless to say, if the bills are rejected reasons have to be accompanied by such order. 4. Neither having been done, I pass the following: ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondent No.2 to consider the representation dated 18.12.2023 at Annexure-A within a period of four weeks from date of receipt copy of this order. - 4 - HC-KAR NC: 2025:KHC:43848 WP No. 24219 of 2025 iii. It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner. iv. In view of disposal of the main petition, pending IA's does not survive for consideration.
