Learned counsel for the applicant submits, applicant was Lekhpal and as per allegation for submitting report on the application of the father of complainant to issue status certificate he made demand of bribe from him and thereafter he was apprehended red handed by the trap team but entire allegation leveled against the applicant is totally false. 5. He further submits, complainant moved an application against the applicant on 20.05.2025 and thereafter on 23.05.2025 applicant was allegedly apprehended by the trap team but on 17.05.2025 applicant had already submitted his report and this fact is evident from Annexure-SA-I to the supplementary affidavit dated 28.07.2025, therefore, there was no occasion for complainant to give bribe to the applicant. 6. bribe of Rs. 5,000/- from the complainant to submit report on the application moved by the father of the complainant to issue status certificate and thereafter he was apprehended red handed by the trap team but could not dispute the fact that from Annexure-SA-I of the supplementary affidavit dated 28.07.2025 it reflects, even before trap on 17.05.2025 applicant had already submitted his report on the application moved by the father of the complainant. 8. Learned AGA further could not dispute the fact that applicant is not having any criminal history and in the present matter he is in jail since 24.05.2025 i.e. for last four months. 9.
I have heard learned counsel for the parties and perused the record of the case. 10. However, as per allegation, applicant was Lekhpal and he made demand of bribe from the complainant to submit report on the application moved by his father for status certificate and thereafter he was apprehended red handed by the trap team on 23.05.2025 but it reflects, on 17.05.2025 applicant had already submitted his report on the alleged application moved by the father of the complainant. 11. Further, applicant is not having any criminal history and investigation has already been completed and in the present matter applicant is in jail since 24.05.2025 i.e. for last four months. 12. Further, law is settled that unless proven guilty an accused is deemed to be innocent and bail application should not be dismissed either for punitive or preventive purpose. 13. Therefore, considering the facts and circumstances of the case discussed above, in my view, applicant is entitled to be released on bail. 14. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 15. Let the applicant -Chandra Prakash be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall appear before the trial court on the dates fixed, unless BAIL No. 24506 of 2025 2
