JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs:- “ 1) Quash the entire proceedings in C.C.No.7825/2023 for the offences punishable under Section 380 and Section 409 of IPC pending on the file of IV Additional Chief Metropolitan Magistrate, Bangalore against the Petitioner. 2) Set aside the order dated: 28.03.2023 of the Hon’ble Court of XXX Additional Chief Metropolitan Magistrate, Bengaluru in C.C.No.7825/2023 taking cognizance of offences punishable under Section 380 and 409 of IPC in the interest of justice.” 2. Heard learned counsel for the petitioner and learned HCGP for 1st respondent as well as learned counsel for the 2nd respondent and perused the material on record. 3. Petitioner – accused No.1 is physically present before the Court, while the 2nd respondent - complainant has appeared through video conferencing. 4. The 2nd respondent-complainant has filed an Affidavit dated 26.11.2025 to the effect that the dispute between the - 3 - HC-KAR NC: 2025:KHC:49380 CRL.P No. 13472 of 2025 petitioner and 2nd respondent has been resolved and the impugned proceedings may be quashed. The said Affidavit dated 26.11.2025, reads as under:- AFFIDAVIT IN SUPPORT OF THE CRIMINAL PETITION FILED UNDER SECTION 528 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 BY THE PETITIONER “ I, P. Krishna Raj Chedga, Aged about 78 years, S/o. Subraya chedga, Resident of Prithvi Classic, Flat No.304, 19th Cross, 20th “A” Main, SMS Layout, J.P.Nagar 5th Phase Bengaluru – 560 078, do hereby solemnly affirm and state on oath as follows: 1. I am the Second Respondent in the above case. I am conversant with the facts of the case and as such I am swearing this affidavit out of my own free will and violation. 2. The Petitioner herein has preferred the above Criminal Petition seeking the relief of quashing of the Order of Cognizance dated 28.03.2023 passed by the XXX Additional Chief Metropolitan Magistrate, Bangalore City in CC No. 7825 of 2023 taking Cognizance of the offences which are made penal under Sections 380 and 409 of the Indian Penal Code in which case the Petitioner herein is arraigned as the Accused No.1. The registration of the said case was on the basis of the Complaint filed by me before the First Respondent Police Station. 3. I state that there were multiple disputes between the Petitioner, who is my daughter-in-law and my son, arising out of their matrimonial life, which have resulted in multiple - 4 - HC-KAR NC: 2025:KHC:49380 CRL.P No. 13472 of 2025 litigations, which are being laid a quietus to by way of mediation. 4. We have decided to resolve the said disputes amicably within the family. without prolonging the same before any forum of law. 5. I submit that I am desires of maintaining peace and harmony within the family and am therefore willing to lay a quietus to the said disputes Accordingly, I have no objection for the quashing of the proceedings in the above case as against the Petitioner herein, in the interest of maintaining harmony. 6. However, I respectfully state that my consent for quashing the said proceedings is being given solely for the purpose of maintaining peace an goodwill within the family, and I do not admit that the contents of the Complaint filed by me are false or incorrect. 7. In view of the amicable resolution of the dispute which has been arrived between the parties herein, the case in Crime No. 77 of 2025 register Byatarayanapura Police Station, Bangalore, as against the Petitioner who is arraigned as an Accused, for the alleged commission of an which is made penal under 'Section 115(2), 352, 63(b) and 7 Bharatiya Nyaya Sanhita 2023, begs for being quashed as against Petitioner herein, at the hands of this Hon’ble Court. I, therefore, request this Hon'ble Court to order the quashment of the proceedings in CC No. 7825 of 2023 pending before the XXX Additional Chief Metropolitan Magistrate, Bangalore City, in which the Petitioner herein is arraigned as the Accused No.1 for the offences made penal - 5 - HC-KAR NC: 2025:KHC:49380 CRL.P No. 13472 of 2025 under Sections 380 and 409 of the Indian Penal Code, in the ends of justice. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) Petition is disposed of in terms of the Affidavit dated 26.11.2025. (ii) The entire proceedings in C.C.No.7825/2023 (arising out of Crime No.240/2022 registered by the 1st respondent – Police) registered for the offences punishable under Sections 380 and 409, pending on the file of XXX Addl.CMM, Nrupathunga Road, Bangalore, insofar as the petitioner is concerned are hereby quashed.
