JUSTICE MOHAMMAD NAWAZ ORAL ORDER A case in Crime No.427/2025 is registered at Banaswadi Police Station, Bengaluru City against accused Nos.1 to 3 for the offence Punishable under Section 115(2), 118(1), 352, 351(2) and 3(5) of the BNS, 2023. 2. Petitioner, arraigned as accused No.1 was arrested on 21.07.2025. He is in judicial custody since then. 3. First information lodged by one Murugan goes to show that on 06.07.2025, at about 06:30 a.m., his brother's son Ajay-accused No.1 and his friends came to his house and took his son, Santhosh along with them and - 3 - HC-KAR NC: 2025:KHC:36431 CRL.P No. 11933 of 2025 later at about 09:30 a.m., his relative by name Nikhil informed him that his son has been assaulted by Ajay and his friends. 4. It is the case of prosecution that the petitioner-accused No.1 along with his friends, took first informant's son Santhosh to the terrace of his house and abused him stating, he is not responding whenever they call him and assaulted him with a cricket bat, rod and chopper and while escaping, he fell down from the terrace and sustained injuries. 5. It is submitted that accused No.1 is none other than the victim's cousin. It appears that the incident is on account of a petty quarrel. Though it is alleged that the accused have assaulted the first informant's son, with cricket bat, rod and chopper and caused injuries to him, as per wound certificate, injuries sustained by him are Abrasions, stated to be simple in nature. Petitioner has no criminal antecedents. He has been arrested and interrogated. He is not required for further interrogation. - 4 - HC-KAR NC: 2025:KHC:36431 CRL.P No. 11933 of 2025 In the facts and circumstances, relief sought in the petition can be granted by imposing conditions. Accordingly, the following:- ORDER i) Petition is allowed. ii) Petitioner/accused No.1 in Crime No.427/2025 of Banaswadi Police Station, pending on the file of X Additional CJM Court, Mayohall, Bengaluru, shall be enlarged on bail, subject to following conditions: 1. He shall execute a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. - 5 - HC-KAR NC: 2025:KHC:36431 CRL.P No. 11933 of 2025 4. He shall not indulge himself in committing any offence. 5.
