This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 03/2025 registered at Police Station – Dongargaon, District- Rajnandgaon, (C.G.) for the offence punishable under Sections 420 and 34 of the Indian Penal Code, 1860.

The prosecution's case, in brief, is that on 11.01.2025, a written complaint was received from Parmanand Netam, who works on a contractual basis at the post ofÏce in Village Charbhata, Rajnandgaon. 2 present applicant to co-accused persons namely, Gyan Prakash Sahu, Yogesh Kumar Sahu, and Dev Krishna. They allegedly persuaded him to invest money with the promise of doubling it within two years. Initially, due to insufÏcient funds, he declined. However, in 2021, he was convinced to invest Rs.6,00,000/- which was transferred to the account of co-accused Yogesh Kumar Sahu. After the investment period ended, upon requesting a refund, he was informed that the company in which the money was invested had liquidated, and thus, the invested amount could not be returned. Consequently, an FIR was lodged.

Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in this case. He also submits that after the FIR it has come to the knowledge of the applicant that the complainant has received invested money from the account of co-accused person Yogesh Kumar Sahu on
16.01.2025. He further submits that due to this settlement between the complainant and the co-accused, the complainant expressed no objection before the learned trial Court regarding the granting of anticipatory bail. He further submits that the applicant is a government employee from a reputable local family, holds a good reputation on society and further he has no criminal antecedents, therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel, opposes the prayer for grant of anticipatory bail to the applicant and also the submissions made by learned counsel for the applicant. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature of dispute, and material available in the case diary, it appears that after the FIR it has come to the knowledge of the applicant that the complainant has received invested money from the account of co-accused person Yogesh Kumar Sahu on 16.01.2025 and due to this settlement between the complainant and the co-accused, the complainant expressed no objection before the learned trial Court regarding the granting of anticipatory bail and further he has no criminal antecedents, therefore, I am inclined to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Deena Das Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting OfÏcer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial.
(c) he shall appear before the trial Court on each
4 and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
