ORAL ORDER
In this petition, petitioner has sought for the following relief:-
“i) Issue writ of certiorari or any other appropriate writ or
order quashing entire proceedings in S.C.No.316/2022 on the file of the Principal District Sessions Judge, Mysuru for the offence punishable under Section 341, 504, 307, 323 and 34 of the IPC as per Annexure-A. ii) Issue any other writ or order or direction that deems fit to grant in the circumstances of the case in the interest of justice and equity.”

Learned counsel for the petitioners – accused Nos.1 and 2 and learned counsel for 2nd respondent – complainant have filed an application for compounding offence under Section 320 read with Section 482 of Cr.P.C., duly filed along with Joint Affidavit

duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioners – accused Nos.1 and 2, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the application for compounding offence under Section 320 read with Section 482 of Cr.P.C., duly filed along with Joint Affidavit, which reads as under:-
“APPLICATION FOR COMPOUNDING OFFENCE UNDER SECTION 320 R/W 482 OF CRPC
It is respectfully submitted as follows:-
1. That the petitioners the petitioners are seeking quashing of entire proceedings in S.C.No.316 of 2022 on the file of The Prl District sessions Judge, Mysore for the offence punishable under section 341, 504, 307, 323 and 34 of the IPC, pursuant to the criminal proceedings initiate by the Respondent No.2/Complainant. 2. That on 16.09.2020. an FIR came to be registered against the petitioners for the offences punishable under Sections 341, 504, 307, 323, and 34 of the Indian Penal Code. It was alleged that there existed a civil dispute pertaining to the pathway leading to the petitioners property involving Respondent No.2, and subsequently, a mediation was conducted by the villagers to maintain peace and harmony within the village. - 4 -

3. It is further alleged that, notwithstanding the mediation, Respondent No.2 instituted a civil suit before the competent court. Thereafter, on 16.09.2020 at about 09:30 a.m., the petitioners allegedly wrongfully restrained the de- facto complainant, abused him in filthy language, and Petitioner No.1 is alleged to have assaulted him with a sickle, while Petitioner No.2 allegedly engaged in physical assault upon the complainant. Consequently, a complaint came to be registered before Beechanahalli Police Station. 4. Based on the said complaint dated 16.09.2020, the jurisdictional police registered an FIR in Crime No.80/2020 for the offences punishable under Sections 341, 504, 307, 323, and 34 of the IPC. Upon completion of investigation, the jurisdictional police filed a charge sheet on 03.08.2023 for the offences punishable under Sections 341, 504, 307, 323, and 34 of the IPC

That the Petitioners and the Respondent no.2 in the above case are persons of the same village. The Petitioner 1 to 2 herein and the Complainant/Respondent No.2 have compromised and settled their above case due to the intervention of the well-wishers and friends and amicably settling the civil dispute that was existing between them. 6.In view of the above settlement the Complainant/ Respondent No. 2 is not wishing to continue with the above case as against the Petitioner No.1 to 2 herein. Having regard to the fact that the parties have settled their dispute continuation of proceedings in proceedings in S.C.No.316 of

2022 on the file of The Prl District sessions Judge, Mysore for the offence punishable under section 341, 504, 307, 323 and 34 of the IPC, would result in abuse process of law. 7. It is submitted that the Petitioners and Complainant/ Respondent No.2 have compromised and settled the above case and they have got no further claim as against each other and also both the parties shall have no right to institute any proceedings/case before the court of law as against each other. Wherefore, it is humbly prayed that, this Hon'ble court may be pleased to permit the above-named Petitioner No. 1 to 2 and the Respondent No. 2 /Complainant to compound and compromise the above case in the interest or justice.
JOINT AFFIDAVIT
I, CHIKKANANJAIAH, S/o late Bhogaiah, aged about 65 years, R/at Belathuru village, H.D Kote taluk, Mysore- 571114 today at Bengaluru, the ACCUSED NO.1/ PETITIONER NO.1
I, REVANNA S/o Chikkananjaiah aged about 29 years, R/at N Belathuru Village, H.D. Kote Taluk, Mysore- 574114, today at Bengaluru, ACCUSED NO.2/ PETITIONER NO.2
AND
I, NANJAPPA B.M. Aged about 70 years, S/o Late Madappa, R/at N Belathuru Village, H.D. Kote Taluk,

Mysore-574114 today at Bangalore, the COMPLAINANT/ RESPONDENT NO.2, do hereby declare and state as follows:
1. The Petitioner No. 1 to 2 are the villagers in the same village as the complainant. 2. Based on the complaint, the Police have registered FIR in Crime No.80/2020 for the offence punishable under section 341, 504, 307, 323 and 34 of IPC. The jurisdictional police after investigation has filed charge sheet for the offence punishable under section 341, 504, 307, 323 and 34 of IPC. Thereafter, the Trial Court proceeded to register criminal case proceedings in S.C.No.316 of 2022 on the file of The Prl District Sessions Judge. 3. That the Petitioners in the above case and the complainant have compromised and settled their dispute due to the intervention of the relatives, well-wishers and friends. 4. The Respondent No.2 submits that she has agreed to co-operate in quashing of the entire proceedings in S.C.No.316 of 2022 on the file of The Prl District Sessions Judge, Mysore for the offence punishable under section 341, 504, 307, 323 and 34 of the IPC and has no objections to quash the said proceedings. 5. In view of the settlement, we pray for quashing of the entire proceedings in S.C.No.316 of 2022 on the file of The Prl District sessions Judge, Mysore for the offence

punishable under section 341, 504, 307, 323 and 34 of the IPC and has no objections to quash the said proceedings. 6.
We state that all the above stated averments contained in this affidavit are all true and correct to the best of our knowledge information and belief and nothing is concealed therefrom.”
4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following:
ORDER (i) The petition is disposed of in terms of the application for compounding offence under Section 320 read with Section 482 of Cr.P.C., duly filed along with Joint Affidavit dated
21.07.2025. (ii) The proceedings in S.C.No.316/2022 (arising out of Crime No.80/2020 of 1st respondent – Police) registered for the offences punishable under Sections 341, 504, 307, 323 and 34 of IPC pending on the file of the *IV Addl. District and Sessions Judge, Mysuru, insofar as the petitioners are concerned are hereby quashed.
