JUSTICE ALOK KUMAR PANDEY ORAL ORDER 2 18-09-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant. 2. The petitioners are apprehending their arrest in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 681 of 2023 initially registered for the offences punishable under Sections 147, 148, 149, 307, 325, 354, 504 of the IPC and later on, Sections 302, 34 of the IPC have been added. 3. As per prosecution case, petitioners and other armed with lathi, danda, bhala and gadasa came to the house of informant and started abusing him. In the meanwhile, co- accused Yadunandan Singh and petitioner no. 5 exhorted others. Thereafter, all the accused persons started assaulting the informant's son. When the informant's wife and daughter came to rescue the informant's son, petitioner nos. 4, 6 and others thrashed them and also dragged them on the ground.
Meanwhile, all the women started assaulting the informant's son as a result of which informant's son became unconscious. 4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence as alleged in the FIR and they have falsely been implicated in this case. Petitioners no. 1, 2, 3, 4 and 6 bear no criminal antecedent whereas petitioner no. 5 bears criminal antecedent of one case in which he is on bail. He further submits that alleged occurrence took place on 04.09.2023 and informant's son Raj Kumar Singh died on 13.09.2023 during course of treatment. There is no specific allegation against any of the petitioners rather the same is general and omnibus in nature. Learned counsel at para-11 of the bail petition has stated that informant's son was chased by the villagers and motorcycle of the informant's son dashed with

He further submits that Investigating Officer of the case has submitted final form against the petitioners and the petitioners are apprehending their arrest only on the ground that the concerned court while differing from the opinion of Investigating Officer took cognizance against the petitioners (Annexure-3). 5. The learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for anticipatory bail of the petitioners and submitted that name of the petitioners finds place in the FIR and cognizance has also been taken against them and in the light of aforesaid facts, petitioners do not deserve anticipatory bail. 6.
Considering the facts and circumstances of the case, final form has already been submitted against the petitioners, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial
