"The undersigned Counsel for the Appellant herewith prays that this Hon'ble Court be pleased to permit the Appellant to withdraw the above appeal with a liberty to file before the Sessions Court in view of the Judgment passed by the Hon'ble Supreme Court, in the interest of justice and equity".
2. The memo is accepted and taken on record.
3. In view of the memo, the appellant is permitted to withdraw the appeal. Accordingly, the Criminal Appeal stands disposed of reserving liberty to the appellant to file an appeal before the Sessions Court as prayed for.
