Page No.# 2/3 ORDER Date : 24.02.2025
Heard Mr. R. Majumder, learned counsel for the applicant.
2. The present Interlocutory Application has been instituted praying for correction of a typographical error occasioning in paragraph-17 of the order dated 05.02.2025, passed by this Court in WP(C) 2232/2023.
3. In paragraph-17 of the said judgment and order dated 05.02.2025, passed in WP(C) 2232/2023, the respondents were directed to prepare a proposal for authorizing to the petitioner his pension and pensinoary benefits w.e.f. “01.04.2024”. However, it is noticed that the petitioner had superannuated from service w.e.f. “31.12.2023”, and accordingly, his pension and pensionary benefits would be required to be so disbursed to him w.e.f. “01.01.2024” and not from “01.04.2024” as recorded in paragraph-17 of the said judgment and order.
4. I have considered the submissions made by the learned counsel for both the parties and also perused the materials available on record.
5. This Court is of the view that a typographical error has admittedly occasioned in paragraph-17 of the said judgment and order dated 05.02.2025 passed in WP(C) 2232/2023.
6. Accordingly, it is directed that the date “01.04.2024” as recorded in paragraph-17 of the said judgment and order dated 05.02.2025 passed in WP(C) 2232/2023, shall now be read as “01.01.2024” for all intent and purpose.
7. The present order would form a part of the judgment and order dated 05.02.2025 passed in WP(C) 2232/2023 and would be considered together for all purpose.
