(FILED U/S.528 BNSS) PRAYING TO QUASH THE PROCEEDINGS PENDING AGAINST THEM IN C.C.NO.293/2024 BY WOMEN POLICE STATION, TUMAKURU, FOR OFFENCES PUNISHABLE UNDER SECTIONS 498-A, 323, 504, 506 READ WITH SEC.149 OF IPC AND SECTION 3 AND 4 OF DOWRY PROHIBITION ACT, PENDING ON THE FILE OF THE HON'BLE COURT OF II ADDL.

CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER Except for petitioners No.3 and 5, all other petitioners are present before this Court. The second respondent, who is the daughter-in-law, is also present. On being enquired, she submits that she has rejoined the marital home of her in-laws and is presently residing with her husband/accused No.1. Petitioner No.1, who is also present before this Court, confirms the settlement and acknowledges that the wife has rejoined the marital home.
2. In view of the amicable settlement between the parties, it is evident that the matrimonial dispute has been resolved. Though the offence under Section 498A of the IPC is

HC-KAR NC: 2025:KHC:35053 CRL.P No. 13229 of 2024 not compoundable, considering that the wife has resumed cohabitation with her husband and accused No.1 has assured before this Court that they will continue to live together cordially, this Court is of the opinion that no fruitful purpose would be served by continuing the criminal proceedings. On the contrary, continuation of the proceedings would amount to an abuse of the process of law. Accordingly, this Court deems it just and proper to quash the proceedings in C.C.No.293/2024.
3. Taking into account that the complainant/wife has expressly acquiesced to the settlement and is presently residing with accused No.1 and leading her marital life, this is a fit case for exercise of inherent jurisdiction under Section 482 of the Code of Criminal Procedure, 1973.
ORDER i. The criminal petition is hereby allowed. ii. The proceedings in C.C.No.293/2024 pending on the file of the II Additional Senior Civil Judge and JMFC, Tumakuru, are hereby
