Issue a writ, order or direction in the nature of Mandamus directing the Respondents 2 and 3 to consider the representation dated 21.04.2025 (Annexure-C) to allot 40% of undeveloped land where the college playground is situated out of the acquired land belonging to the Petitioner. ii. Any other appropriate writ or order or direction that be deemed fit to grant under the facts and circumstances of the case, be passed in the interest of justice and equity.” - 3 - HC-KAR NC: 2025:KHC:32131 WP No. 22936 of 2025 2. Heard Sri Bipin Hegde, learned counsel for petitioner, Sri Spoorthy Hegde N., learned High Court Government Pleader for respondent No.1 and Sri Shivaprasad Shantanagoudar, learned counsel for respondent Nos.2 and 3. 3. This very petitioner was before the division bench in W.P.No.10229/2023. The division bench disposed the petition in terms of the order dated 14.11.2024, which reads as follows: “The petitioner before this court, seeks the following prayers: "ia. Issue a writ, order or direction in the nature of certiorari and quash the Final Notification bearing No.UDD/553/MNX/2008 dated October 30, 2020 issued by the Respondent No.1 with respect to the lands of the Petitioner in SY.Nos.55/7, 55/8 and 55/9 of Medi Agrahara village, Yelahanka Hobli, Bengaluru North found at Sl. Nos. 1311, 1312, 1314 of the Final Notification (Annexure S) and consequently quash the Preliminary Notification bearing No.BDA/Coomr/DC(LA) SLAO/A5/PR/283/2008-09 (Annexure A) i. Issue a writ, order or direction in the nature of Certiorari and quash the Award dated January 01, 2022 bearing No.L.A.C./1311/2008-09 (Annexure-M), quash the Award dated February 17, 2022 bearing No.LAC/1312/2008-09 produced as (Annexure N) and quash the award dated January 07, 2022 in L.A.C./1313/2008-09 (Annexure-P); ii. PÁ£ÀÆ£ÀÄ D¢üPÁjUÀ¼ÀÄ, ¨ÉA.C.¥Áæ, ¨ÉAUÀ¼ÀÆgÀÄ gÀªÀgÀ ªÀiÁ»wUÁV ºÁUÀÆ ªÀÄÄA¢£À PÀæªÀÄPÁÌV ¸À°è¸À¯ÁVzÉ.” 4. The chart found in the report of inspection has 14 buildings in it. Out of the 14 buildings, it was suggested by the petitioner that buildings at Sl.Nos.6, 7 and 8 supra, could be dropped from acquisition or to be retained by the petitioner. The learned counsel appearing - 7 - HC-KAR NC: 2025:KHC:32131 WP No. 22936 of 2025 for the BDA would accept the fact that the security area at Sl.No.6, the approach road to the building at Sl.No.7 and the visitors waiting hall in Sl.No.8 would be left out from acquisition. The learned Senior Counsel at this juncture would submit that at Sl.Nos.13 and 14, is a small area where temple exits, and at Sl.No.14 is a tomb, which are 645, and 150 sq.ft respectively. 5. The learned counsel Sri.Shivaprasad M Shantanagoudar appearing for the BDA would accept the suggestion of learned Senior Counsel Mr.Ashok Haranahalli appearing for the petitioner to drop Sl.Nos.13 & 14 on the instructions of Dr.B.R.Harish, SLAO-3, who is present before the court. In that light, the acquisition in so far as the petitioner's property is concerned, shall have its exclusion at Sl.Nos.6, 7, 8, 13 and 14 which would be security approach road to buildings, visitors waiting hall, temple and tomb. The learned Senior Counsel would submit that in so far as the other relief is concerned, with regard to the compensation under 60:40 ratio of developed land is concerned, the same should be considered in an adjacent area. The learned counsel Sri.Shivaprasad M Shantanagoudar would submit that it would be considered as far as possible depending upon the planning of the area. With these submissions and what is recorded herein above and the observations, the petition stands disposed.” (Emphasis supplied) At paragraph No.5 of the afore-quoted order, the division bench on hearing the parties, had observed that the learned senior counsel for the petitioner had there submitted with regard to compensation under 60:40 ratio of developed land and the same should be considered in an adjacent area. Learned Counsel for the respondents – Bengaluru Development - 8 - HC-KAR NC: 2025:KHC:32131 WP No. 22936 of 2025 Authority had submitted that orders would be passed considering the plea of the petitioner. After the disposal of the said writ petition, a representation is made and the subject petition is now preferred with a slightly altered grievance. 4. Learned counsel for respondent Nos.2 and 3 – Bengaluru Development Authority submits that the representation of the petitioner would be considered and prays that no order be passed on the status quo, qua the property to be maintained by the parties. 5. Learned counsel for the petitioner submits that if a direction is issued to consider the representation, it would suffice for the present. 6. In the light of the aforesaid submission, the respondents – Bengaluru Development Authority shall now consider the representation of the petitioner submitted on 21.04.2025 strictly in consonance with law and pass necessary orders thereon, within an outer limit of four weeks from the date of receipt of a copy of the order. - 9 - HC-KAR NC: 2025:KHC:32131 WP No. 22936 of 2025 7.
