Neutral Citation No. - 2025:AHC:116670 Court No. - 5 Case :- WRIT - A No. - 9847 of 2025 Petitioner :- Ajay Kumar Gupta Respondent :- State Of Uttar Pradesh And 7 Others Counsel for Petitioner :- Sarvesh Kumar Pandey,Shiv Kumar Singh Counsel for Respondent :- C.S.C.,Kunwar Bahadur Srivastava Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Sarvesh Kumar Pandey, learned counsel for petitioner, Sri Kunwar Bahadur Srivastava, learned counsel for respondent Nos.5 and 6. The petitioner is a complainant, who has claimed that he is still member of the Society i.e. Markuwon Kisan Sewa Sahkari Samiti Ltd., Vikas Khand Gursarai, District Jhansi.
Learned counsel for petitioner in support of above submission refers a document issued way back in the year 2001, however, there is no recent document on record that petitioner is still a member of concerned society. Petitioner has approached this Court that a Three Member Committee was constituted by the State to look into the allegations against respondent No.8, however, till date, said committee has not submitted its report.
Learned counsel for respondent on basis of instructions submits that coram of committee is disbursed since one of members is transferred and will take all endeavour to reconstitute the committee and complete the inquiry against said respondent, in accordance with law. In aforesaid circumstances, though petitioner does not appear to be any locus to file this writ petition, since he is not able to show that he is still member of the Society as well as there is no document that he has tried to pass a resolution for expeditious decision of inquiry by Three Member Committee, still considering that since respondents State is under legal obligation to conclude the inquiry, therefore, this writ petition is
disposed of with an observation that they will take all endeavour to conclude the inquiry by said Three Member Committee.
