This petition is preferred under Section 483 of BNSS, 2023 to enlarge the petitioner/accused No.3 on bail in S.C.No.55/2025 pending before the VI Additional District and Sessions Judge at Bengaluru Rural District, Bengaluru. 3. FIR is registered against four to five unknown persons in Crime No.148/2024 of Nandagudi Police Station, Bengaluru District, on a complaint lodged by one Shashank.V., brother of deceased - Bhargav, in respect of an incident of assault and murder, which took place on 12.07.2024 at about 11.30 p.m. near Ramasandra Gate, - 3 - HC-KAR NC: 2025:KHC:37153 CRL.P No. 11519 of 2025 Gangapur Village, Nandagudi Hobali, Hosakote Taluk, Bengaluru District. 4. Charge-sheet is filed against accused Nos.1 to 5 for the offence punishable under Sections 103, 189(2), 190, 191(2), 191(3) 61(2) of the BNS 2023. Petitioner is arraigned as accused No.3 in the charge-sheet. 5. Prosecution has alleged that accused Nos.1 and 2 had ill-will against the deceased-Bhargav and his brother Shashank. Hence, they hatched a plan to eliminate Bhargav. On 12.07.2024, they allegedly followed the deceased in a car. The car, in which, the deceased was proceeding, met with an accident near Ramasandra Gate, Gangapur Village. After the accident, when he was standing by the side of the road, the accused who were following him, attacked him with lethal weapons and committed his murder. 6. According to prosecution, CWs.2 to 4 are the eyewitnesses. The allegations against all the accused are - 4 - HC-KAR NC: 2025:KHC:37153 CRL.P No. 11519 of 2025 similar. Undisputedly, accused Nos.1, 2 4 and 5 are enlarged on bail by this Court in Crl.P.No.8404/2025 dated 22.07.2025; Crl.P.No.459/2025 dated 07.03.2025 and Crl.P.No.2385/2025 dated 23.04.2025. This Court in Crl.P.No.8404/2025, while granting bail to accused No.1 has taken into consideration that the incident took place at about 11.30 p.m. CWs.2 to 4 have stated that they saw the assailants with the help of headlight of other vehicles which were moving on the road. However, their features are not stated by any of the eye-witnesses. It is also contended by the learned counsel for the petitioner that in the test identification period, eye-witnesses have not identified the assailants. 7. Petitioner was arrested on 15.07.2024. Investigation is completed and charge-sheet is filed. Since accused Nos.1, 2, 4 and 5 are enlarged on bail, petitioner is also entitled for bail, on the ground of parity. Accordingly the following order: ORDER - 5 - HC-KAR NC: 2025:KHC:37153 CRL.P No. 11519 of 2025 i) Petition is allowed. ii) Petitioner/Accused No.3 in S.C.No.55/2025 pending before the VI Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru (CCH-67) arising out of Crime No.148/2024 of Nandagudi Police Station, shall be enlarged on bail, subject to the following conditions: 1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the like-sum to the satisfaction of the Jurisdictional Court. 2. He shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons. 3. He shall not directly or indirectly threaten or tamper with the prosecution witnesses. 4. He shall not involve in similar or other offences in future. 5. He shall not leave the jurisdiction of the Trial Court without permission of the said - 6 - HC-KAR NC: 2025:KHC:37153 CRL.P No. 11519 of 2025 Court until the case registered against him is disposed of.
