Memo reads as under: "Respondent has filed suit in O.S.No.1512/2009 against the original petitioner Smt.Padma for partition and separate possession of the suit schedule property. On 19.04.2012 the said suit came to be dismissed for non-prosecution. Challenging which the Respondent filed Misc.No.53/2013 for seeking restoration of original suit and said Miscellaneous case was allowed and thereby restored the suit O.S.No.1512/2009 on its file. Hence the petitioner has filed the above CRP. In the mean time suit in O.S.No.1512/2009 is decreed on 19.07.2025, therefore the present CRP is infructuous.
