3. A modification application has been preferred by the applicants seeking correction of certain inadvertent typographical errors in the
judgment and order dated 09.02.2026. It is submitted that in paragraph no. 4 of the said
judgment, the provision has been incorrectly mentioned as “Section 23 B.N.S.S.” whereas the correct provision is “Rule 23 of the Uttarakhand Bharatiya Nagrik Suraksha Rules, 2024.” It is further prayed that in paragraph no. 8 of the judgment, instead of the direction to
“release the vehicle listed in paragraph 6 of the counter affidavit,” the direction be modified to read that the vehicles be released in favour of the respective applicants (owners), as detailed in Annexure No. 7 to the present C-528 application.
4. Upon consideration of the submissions and perusal of the record, it is evident that the aforesaid errors are clerical/typographical in nature.
5. Accordingly, the modification application is allowed.
6. The judgment and order dated 09.02.2026 stands modified to the following extent:
(i) In paragraph no. 4, the expression
“Section 23 B.N.S.S.” shall be read as “Rule 23 of the Uttarakhand Bharatiya Nagrik Suraksha
Rules, 2024.”
(ii) In paragraph no. 8, the direction shall be read as: “It is directed that the competent authority shall release the 48 vehicles in favour of the respective applicants (owners), including the vehicles bearing registration nos. UK-02-CA- 0861, UK-02-CA-0763, UK-02-CA-0615, UK-02- CA-0984, UK-02-CA-9328, UK-02-CA-0805, UK- 02-CA-0394, UK-02-CA-0448, UK-02-CA-0865, UK-02-CA-0572, UK-02-CA-0715, UK-02-CA- 0363 and UK-02-CA-0503.”
7. The remaining part of the judgment and
order dated 09.02.2026 shall remain unaltered.
