Neutral Citation No. - 2025:AHC:114439-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1791 of 2025 Petitioner :- Anand Kumar Respondent :- State of U.P. and 7 others Counsel for Petitioner :- Dinesh Kumar Counsel for Respondent :- Dr. Avneesh Tripathi, Archana Srivastava, Jagdish Pathak, S.C., Pankaj Srivastava Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition has been filed by the petitioner purportedly in public interest, seeking a direction to the respondents to take action for removing the encroachment over 20 feet wide Gata No. 38 public road registered under the revenue record of Mohalla Aurang Shahpur Diggi, Nagar Nigam, Meerut. 2. A perusal of the writ petition indicates that there has been a long standing dispute between the University and villagers-respondent nos. 7 and 8, which was resolved by the State-authorities on 21.06.2012 and 06.02.2023 and now again, dispute appears to have arisen, based on which, the present PIL has been filed. 3. A perusal of the documents annexed with the petition reveals that for determination of the dispute, the parties need to lead evidence in absence of which, the same cannot be decided and, therefore, the present PIL cannot be entertained. The same is, therefore, dismissed, leaving it open for the petitioner to take appropriate proceedings under the U.P. Revenue Code, 2006 in accordance with law.
