Petitioner Karnail Singh alias Lott has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 142 dated 27.05.2025 under Section 115, 127(2), 351(2), 64(1), 74, 76 and 78 of Bharatiya Nyaya Sanhita, 2023 (later on added Section 64 and 115(2) of BNS, 2023) registered at Police Station Babain, District Kurukshetra.

As per the facts of case, FIR has been lodged on the written complaint of prosecutrix ‘SK’. Prosecutrix alleged that she is a widow lady having three children. She is residing in her parental house. She came in contact with Karnail Singh alias Lott through her father as he needed money for construction of house. about 15-20 minutes, he again called on her phone that her father had reached in his office and she should also reach there. Prosecutrix did not know address of his office. On this, she was told to reach Shahabad Road, from where he came to pick her up. At about 01:00 pm, she reached the office of accused and after some time, two unknown persons came in the office who were hiding in bathroom. They were with muffled faces. One of them gave her water. Door of the office was bolted. Said persons indulged in obscene acts with her. They did wrongful act with her, gave her beating and had torn her clothes and gave her threats. She was left outside her house on a motorcycle at about 03:00 pm. She remained under fear and finally matter was reported to police.

Learned counsel for petitioner pointed out that matter was compromised with prosecutrix. Copy of compromise dated 17.06.2025 is Annexure P-1. Petitioner has already joined investigation on 24.07.2025. He is ready to abide by terms of bail order.

Status report filed today which is taken on record, subject to all just exceptions. It is pointed out that there are serious allegations against petitioner. Copy of her statement recorded under Section 183 BNSS, 2023 is Annexure R-1. Copy of her MLR is Annexure R-2. Call detail record of petitioner and victim is Annexure R-4. It is confirmed that petitioner has joined investigation and is not required for any other purpose.

On the other hand, Mr. Gautam Kumar, Advocate appeared and filed Vakalatnama on behalf of respondent No. 2, which is taken on record. He has confirmed the compromise (Annexure P-1) and did not oppose anticipatory bail petition.

Considering the aforesaid factual position, no purpose would be served by sending petitioner behind the bars. He has already joined investigation and cooperated with Investigating Agency. No doubt allegations are serious. Compromise is taken into account for the purpose of disposal of anticipatory bail petition only. In the light of this, anticipatory bail petition filed by petitioner Karnail Singh alias Lott is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of BNSS, 2023.
